In order to implement
the article 66 paragraph 5 Patent Law No. 14 year 2001 concerning with
recordation of patent assignment, the President of Republic of Indonesia issues
a regulation concerning with the requirements and procedures for recording
patent assignment taking effect as from 7 June 2010.
Requirements
The requirements for recording patent assignment are:
1. Original patent certificate
2. Original Deed of Assignment, Notarized and sworn translated to
Bahasa.
3. Power of Attorney
4. Official payment receipt of application for recording patent
assignment
5. Photocopy of annuity
payment receipt for the current year.
Procedure
Upon receipt of the
application for recordal with complete formalities, within 30 days thereof, the
Patent Office will record the patent assignment in the Patent General Register and
publish it. As prove of recordation, the Patent office will append a note of recorded
assignment on the patent certificate.
Existing Recordal Applications
For recordal
applications filed before the enactment of this Presidential Regulation, the
Patent Office will issue notice of lack of requirements to the applicants
within 60 days as from the enactment of this regulation (by 31 August 2010).
The applicant will be given a chance to fulfill deficiencies within 90 days
upon receipt of the Notice; failure to meet the deadline shall make the
application for recordal be deemed withdrawn.
