The Indonesian Trademark Appeal Commission was officially established in 2005 by virtue of Government Regulation no. 7/2005. The Commission has 3 year period of duty to meet the requirement stipulated by Law to complete appeal examination within 3 months after filing but only few applications were decided by the time the period of duty expires because of limitations in administrative systems and resources.
The new Trademark Appeal Commission appointed in 2008 had to face backlog files of over 900 applications. With a commitment to meet the statutory deadline, the Trademark Appeal Commission worked very hard to clear up the backlogs and now managed to complete it. Among 900 applications, 35% was accepted either entirely or partially.
Any party who does not satisfy with the appeal decision may file a second appeal to the Commercial Court then cassation to the Supreme Court.
