Indonesia's Standpoint regarding the Restoration of Priority Right - Update

As we have advised in the previous news concerning with Indonesia’s standpoint regarding the Restoration of Priority Right, the Patent Office will treat all applications with restored priority right be deemed withdrawn. Actually this is what happened to the applications filed before the regulation came into force in February 10, 2011.

Indonesian Patent Office Circular Letter regarding the Restoration of Priority Right

On 10 February 2011 through the Circular Letter No. HKI.3-UM.01.01.13 of 2011, the Indonesian Patent Office made formal announcement to confirm its standpoint,, that Restoration of the Priority Right under PCT rule 26 bis.3 and 49 ter.2 is incompatible with national Law. Consequently, patent applications fall within this category will be deemed withdrawn. All fees paid are not re-fundable.

Will cloud overshadowing the Buddha Bar fade away?

As we have posted in earlier Acemark News, the Anti Buddha Bar Forum (FABB) succeeded to force the DGIPO to cancel registration of the trademark Buddha Bar No. IDM00018981 covering services in class 43 in the name of George V Restouration, the licensor, on April 15, 2009. However, even though the business no longer has trademark rights, it kept on running under confidence of the licensee, PT. Nireta Vista Creative because the business permit is still valid.

Take a walk around the streets in Jakarta or other big cities in Indonesia, and you will see pirated DVDs and CDs being openly sold by street vendors for about 10 thousand Rupiah a piece (equal to US$1). This fact is just the tip of an iceberg of copyrights problems. Indeed, Indonesia remains to be one of the countries with high piracy levels. 86% of software installations for personal computers in 2009 are unlicensed. Its value reached 886 million US dollars.

Bayer AG vs. Behn Meyer & Co.(M) SDN.BHD (Mesurol, BM Mesuron)

The Commercial Court of Central Jakarta rejected a cancellation lawsuit filed by Bayer against Behn Meyer on November 10, 2010. Bayer alleged Behn Meyer on having a bad faith in registering trademark BM MESURON, for it is similar to MESUROL.

Recordation of Patent Assignment is now effective

In order to implement the article 66 paragraph 5 Patent Law No. 14 year 2001 concerning with recordation of patent assignment, the President of Republic of Indonesia issues a regulation concerning with the requirements and procedures for recording patent assignment taking effect as from 7 June 2010.

APPEAL BACKLOG FILES CLEARED

The Indonesian Trademark Appeal Commission was officially established in 2005 by virtue of Government Regulation no. 7/2005. The Commission has 3 year period of duty to meet the requirement stipulated by Law to complete appeal examination within 3 months after filing but only few applications were decided by the time the period of duty expires because of limitations in administrative systems and resources.
