A design is the overall appearance of a product. The visual features that form the design include the shape, configuration, pattern and ornamentation which, when applied to the product, give it a unique appearance. A registered design can be a valuable commercial asset - registration of a design gives the owner protection for the visual appearance of the product but not the feel of the product, what it is made from or how it works.

To be registrable, a design must be new and distinctive. 'New' means the identical design (or one very similar) has not been publicly.

For example, a design would not be considered new if it had been 'published' on the Internet before the date it was filed (or its priority date, whichever is earlier).

A design is 'distinctive' unless it is substantially similar in overall appearance to other designs already in the public domain.

Before filing an application, you should search existing design records. If your design is not new and distinctive, any registration you recieve could be revoked as a result of examination and your registration could be worthless. You may also face legal action if you infringe the design rights of the owners of other similar designs.

Recordation of Patent Assignment is now effective

In order to implement the article 66 paragraph 5 Patent Law No. 14 year 2001 concerning with recordation of patent assignment, the President of Republic of Indonesia issues a regulation concerning with the requirements and procedures for recording patent assignment taking effect as from 7 June 2010.


APPEAL BACKLOG FILES CLEARED

The Indonesian Trademark Appeal Commission was officially established in 2005 by virtue of Government Regulation no. 7/2005. The Commission has 3 year period of duty to meet the requirement stipulated by Law to complete appeal examination within 3 months after filing but only few applications were decided by the time the period of duty expires because of limitations in administrative systems and resources.


$25,000 FOR CREATIVE PEOPLE

For the first time in Indonesia, on the 2nd October 2009 in Jakarta, 21 the Government gave awards to inventors and scientists in an effort to stimulate and reward creativity. The program which is a follow-up of the President Susilo Bambang Yudhoyono’s instruction at the ministerial session and National Team of Intellectual Property Infringement Tackling in August 2008 is planned to be held annually.
