Issuance of Warning Letters to Pay Outstanding Annuities for Abandoned Patents

In recent times, DGIPO issues warning letters to patentees of abandoned patents through their agents, demanding payment of outstanding annuities with a penalty. As regulated in Article 115 point (1) of Law no. 14 of 2001 regarding Patents, a patent shall be deemed void if within three consecutive years the patentee fails to pay annuity fees by the stipulated deadline. Although the abandoned patent has been considered void, the patentees are still obligated to pay the outstanding annuities.
